Judicial expert assignments, particularly in the field of intellectual property and anti-counterfeiting.An efficient legal instrument in Belgium is the so-called descriptive counterfeit seizure. Article 1369bis of the Belgian Judicial Code allows the proprietor of almost any intellectual property right, who suspects that his rights have been infringed, to file an ex parte application with a Belgian Court in order to obtain a 'descriptive seizure order'. The Court may order a judicial expert to enter the premises of the alleged infringer, unannounced, to collect evidence about the alleged infringement and its scope and to establish a judicial report enabling the proprietor to pursue the infringement. The Court may also order injunctive relief measures, blocking any further distribution of the alleged counterfeit goods.
