I practice nationally, advising defense attorneys and defendants about federal sentence mitigation, plea agreements, appeals, collateral challenges (habeas corpus law), and Bureau of Prisons issues like prison placement, custody, transfer, RDAP, and pre-release planning. With the right facts, I also prepare petitions for Presidential pardons and commutations. I am admitted to full practice before the State Courts of North Carolina and Maryland; the United States Courts of Appeals for the Fourth, Fifth, Sixth, and Tenth Circuits; and the U.S. District Courts for North Carolina's Eastern, Middle, and Western Districts, and the Districts of Colorado, North Dakota, and the District of Columbia. With these full admissions, I have represented defendants in U.S. District Courts around the country on a pro hac vice ("for this case") basis. Besides criminal law practice, I also regularly seek U.S. Government records under the Freedom of Information Act (FOIA) and the Privacy Act. Under certain circumstances, I will also represent plaintiffs in civil actions for constitutional or civil rights violations, or under the Federal Tort Claims Act (FTCA). I will gladly discuss non-federal sentence mitigation with members of any State bar.Areas of Concentration: *U.S. Sentencing Guidelines calculations, with Guidelines and § 3553(a) sentence mitigation;*Federal Bureau of Prisons placement and transfer requests - drug abuse treatment (RDAP) and other programming requests - inmate administrative remedies; *Transfers of court/probation office supervision, and early terminations of Supervised Release; *Post-conviction challenges to federal conviction, sentence, or conditions of confinement (motions under 28 U.S.C. § 2255 and habeas petitions under 28 U.S.C. § 2241); *Federal Freedom of Information Act (FOIA) and Privacy Act requests.
